Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the MarketLago website and its SMS and email alert services (the "Service"), operated by MarketLago. By using the Service or signing up for alerts, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

MarketLago sends alerts when automated analysis flags that Donald J. Trump has spoken or posted favorably about a publicly traded company — on Truth Social or in public remarks such as speeches, press conferences, or interviews.

No guarantee of coverage, accuracy, or delivery. The Service depends on automated capture, transcription, and analysis of third-party sources, and on third-party networks and carriers to deliver messages. It is not comprehensive, real-time, or authoritative. We do not guarantee that any particular post, statement, or event will be detected or result in an alert, or that any alert will be timely, accurate, complete, or delivered. Alerts may be missed, delayed, duplicated, incomplete, inaccurate, or never sent — including as a result of transcription or detection errors, source, network, or carrier outages, or gaps in coverage. You should not rely on the Service as your sole or primary source of information, and the absence of an alert means nothing.

We may change or discontinue the Service. We may modify, limit, suspend, or permanently discontinue the Service — or any feature, alert type, or data source — in whole or in part, at any time, for any reason or no reason, with or without notice, and without liability to you. Because the Service is currently provided free of charge, we make no commitment as to its availability, uptime, response time, or continued operation, and no such commitment should be inferred.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using it, you represent that you meet these requirements.

3. SMS program terms

MarketLago SMS Alerts. MarketLago sends recurring automated SMS alerts notifying subscribers when Donald J. Trump speaks or posts favorably about a publicly traded company — on Truth Social or in public remarks such as speeches, press conferences, or interviews. Message frequency varies. Message and data rates may apply. For help, reply HELP or contact Marketlago@proton.me. To unsubscribe at any time, reply STOP. See our Privacy Policy for how we handle your information; we do not share your mobile opt-in information with third parties for marketing.

4. Not financial or investment advice; not an investment product

MarketLago is an information service only. Nothing in an alert or on this site is financial, investment, legal, tax, or other professional advice, or an offer, solicitation, or recommendation to buy or sell any security or to engage in any transaction. Markets are risky and you may lose money. You are solely responsible for your own decisions and should do your own research and consult a licensed professional before investing.

Not an investment product or regulated entity. The Service is not a security, investment product, fund, signal service, or advisory service, and subscribing to it is not an investment. MarketLago is not a broker-dealer, investment adviser, financial planner, exchange, or financial institution, and is not registered or licensed as any of these with the U.S. Securities and Exchange Commission, FINRA, or any other regulator. We do not hold, manage, or invest your money, custody any assets, execute or facilitate any trades, or provide personalized or individualized recommendations. No advisory, brokerage, fiduciary, or other special relationship is created between you and MarketLago by your use of the Service.

Assumption of risk. We simply tell you what we detected; what you do with it is up to you. Any action you take — or don't take — based on the Service, an alert, or the absence of an alert is at your sole risk and discretion, and MarketLago is not responsible for it. You assume full responsibility for all trading, investment, and other decisions and for any resulting losses.

5. No affiliation

MarketLago is independent and is not affiliated with, endorsed by, sponsored by, or associated with Donald J. Trump, Truth Social, Trump Media & Technology Group, any government entity, or any company named in an alert. All names, logos, and trademarks are the property of their respective owners and are used for identification only.

6. Acceptable use

You agree not to misuse the Service, including by: reselling or redistributing alerts without permission; attempting to gain unauthorized access; scraping, overloading, or interfering with the Service; or using it for any unlawful purpose.

7. Intellectual property

The Service, including its content, design, and software (excluding third-party content such as the underlying posts), is owned by MarketLago and protected by applicable laws. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose.

8. Subscriptions & billing

The Service is currently provided free of charge. If we introduce paid plans, additional terms — including price, billing cycle, automatic renewal, and cancellation and refund policies — will be presented to you before you are charged, and your continued use of a paid plan will be subject to those terms.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MARKETLAGO AND ITS PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, INVESTMENTS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR RELIANCE ON ANY ALERT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR US $50.

11. Indemnification

You agree to indemnify and hold harmless MarketLago from any claims, damages, or expenses arising out of your misuse of the Service or violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Subject to the arbitration agreement below, you agree to the exclusive jurisdiction and venue of the state and federal courts located in the State of Delaware, United States for any dispute.

13. Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully — it affects your legal rights. Except for individual claims that qualify for small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, administered by a recognized arbitration provider under its consumer rules, rather than in court. Judgment on the award may be entered in any court with jurisdiction.

You and MarketLago waive the right to a jury trial and the right to participate in a class, collective, consolidated, or representative action. Disputes will be resolved only on an individual basis, and the arbitrator may not consolidate more than one person's claims.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice to Marketlago@proton.me within 30 days of first accepting these Terms; opting out does not affect any other part of these Terms. If any portion of this Section 13 is found unenforceable, the remainder will remain in effect, except that if the class-action waiver is found unenforceable, this entire Section 13 will be void.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. You may stop using the Service at any time and opt out of SMS by replying STOP.

15. Changes to these Terms

We may update these Terms; the "Effective" date above reflects the latest version. Continued use after a change means you accept the updated Terms.
